Ecuador & Bank Privacy


Bank privacy no longer exists. Some years ago I wrote about the insidious tactics that the US and other governments have used to erode financial privacy and personal liberty and pointed out that the problem is that the government does not attack the individual but puts the pressure on the overseas financial institutions. The current additional move by the US government to collect tax is just one more small step.

The quote above might make it seem like I was years ahead of the curve writing about the loss of privacy some years ago.

Actually I was way ahead of the curve because that quote comes from one of the earlier articles posted at this site on July  13, 2000. See that July 2000 article.

However,  may I remind you that the sunshine not only always shines somewhere, it always rises everywhere… every day!

Glorious.

We live in a quantum world.  Those earthly laws that Newton so accurately described really do seem to work with apples… yet science suggests that our world is not so predictable… every moment… every place contains infinite potentiality for change… something different… something new… something good… or bad.

There are wonderful aspects of living in most places. This is why Merri and I live in Florida, the Blue Ridge and Ecuador.

This is why I have been warning readers since the 1980s to never… ever… hide wealth.  Use legal means of attaining privacy.

These warnings have related mostly to Americans, British and Germans.  These have been the most determined and aggressive taxing authorities.

These warnings have been is a good thing too.  Here is one reason why.

A June 17, 2009 New York Times article entitled E-Mail Surveillance Renews Concerns in Congress shows even deeper concern, explains how bank privacy is really dead.   An excerpt from this article (a link to the entire article is at the end of this message) says:.

The National Security Agency is facing renewed scrutiny over the extent of its domestic surveillance program, with critics in Congress saying its recent intercepts of the private telephone calls and e-mail messages of Americans are broader than previously acknowledged, current and former officials said.

The agency’s monitoring of domestic e-mail messages, in particular, has posed longstanding legal and logistical difficulties, the officials said.

Since April, when it was disclosed that the intercepts of some private communications of Americans went beyond legal limits in late 2008 and early 2009, several Congressional committees have been investigating. Those inquiries have led to concerns in Congress about the agency’s ability to collect and read domestic e-mail messages of Americans on a widespread basis, officials said. Supporting that conclusion is the account of a former N.S.A. analyst who, in a series of interviews, described being trained in 2005 for a program in which the agency routinely examined large volumes of Americans’ e-mail messages without court warrants. Two intelligence officials confirmed that the program was still in operation.

In short not only is bank privacy dead… privacy is dead… morte… gone…finito.

These warnings seem to include Ecuador as well.

Two recent messages, one Ecuador & Banking about new Ecuador financial reporting regulations, and the other Ecuador & Social Security US Social Security regulations relating to those who live and work abroad.

These messages evoked a number of responses from readers asking “How would Ecuador’s tax man know what wealth I have abroad?” and  “How would the Social Security administration know  if I earn in Ecuador?”

My reply is “I do not know how they would know… but I do not do it and do not recommend this because one never knows what will happen!”

There are so many ways the future could be revealed us… but let me give you a clue of just one example where someone hiding wealth could be caught.

My last two Ecuador Living updates outlined details about Ecuador Bank ATM fraud where over 40 people had their accounts cleaned out and how the Ecuador banks immediately made the losses good.   See these updates as an Ecuador Living subscriber.

If there was a cooperation between US and Ecuador authorities investigating this fraud… details of earnings in Ecuador could end up in the US (including SS admin) and details of US wealth could end up in the hands of Ecuador authorities.

We are in a new era of privacy that I have watched unfold during 41 years of doing international investing and business.   Half a decade ago, this site sent this warning in an article The Ultimate Form of Financial Privacy

One should not hide money abroad and rely on bank privacy to protect them. Forget about government attacks. These are bad enough but I cannot begin to tell you the horror stories I have crossed in the past three decades in which bank privacy was blown by bank errors. For example, a London bank mistakenly mailed me the secret bank account of an Iranian diplomat who was hiding money in London. A Viennese banker inadvertently faxed me four pages of private information that could have put several people in serious trouble.  Even a Swiss banker once left his client list with names, addressees and account numbers laying on a table at a seminar were I was speaking with him!

In addition to the onslaught of governments to reduce privacy, there are just too many ways for your wealth to be revealed to use secrecy as a wealth protection tool.

Look for legal ways to keep your financial affairs private instead.

Bank privacy is dead.  Do not try to hide money.  Use as many legal tactics as you can to preserve your wealth…always keep it legal. This is a never ending game and the opponent… taxation authorities play hardball and they play rough.

New Salinas Ecuador Beach Project


Last week we let our Ecuador Living subscribers know about a new Ecuador beach project near Salinas Ecuador.

Dr Andres Cordova has been our friend and attorney in Ecuador for more than a decade. He  has helped many of our readers in many ways.

Punta Carnero is poised to become one of the most important coastal-development areas in Ecuador and if location is important (it certainly is) timing is too. International interest in Ecuadorian coastal real estate is growing by the day, prompted by international conditions, great values to be found in Ecuador, pressing demographics and boomer’s needs too.

For most of Ecuador’s coast, many compromises need to be made, but in Punta Carnero’s case, there are many elements already in place and so many more coming that its is quite “the” option right now.

Ecuador Beach Property Review


Ecuador beach property has always represented incredible value in my opinion.

Now there is an extra value on Ecuador’s beach because rumors have scared some buyers away.  This means that intelligent investors can take advantage of the truism, “Buy on the rumors and sell on the news.”

For example one reader just sent me this note.

Hi Gary, I am really interested in Ecuador and you seem to have so much information. I have been doing some research and found that the most recent President of Ecuador is thinking about confiscating beach properties from foreigners. If this is true and is only including beach front properties. I am interested in buying and living in Ecuador but also really want to live in a very warm to hot climate. I thrive best under these conditions. So could you tell me something about the political climate at this time. I am also interested in your import/export seminar as well as a real estate tour. But before I plunge head first into something I would like to be as well informed as possible. Thanks in advance.

I have never heard this and it seems highly doubtful.  I suspect this is one of those many, groundless rumors that pop up on the internet.  I have copied our friend and attorney, Floridalva Zombrano, who would know if this were so.  Regards,  Gary

Dear Amy and Gary, You are  absolutely right, Gary. This is only a rumor without any legal basis.  Going over our new Constitution I found that Art. 323 states:  “All forms of confiscations are prohibited”.  Amy, If you have any further questions on the legal aspects of buying real estate  here in Ecuador, immigration issues, etc.  I would be happy to assist you.  Kind regards,  Flori.

This is exactly the type of rumor (one that is opposite the truth) that creates the greatest opportunity. This rumor that the President is considering confiscation when the new constitution which he pushed for and strongly supported prohibits all forms of confiscation is exactly wrong…. also at a time when South and North American relations are getting better.

This series starts today as far south as one should probably go on Ecuador’s beach… in Salinas.

The Salinas Malecon area has long been a favorite destination.

Salinas is one of the favorite in Ecuador for good reasons.  It has beautiful beaches, with calm waters perfect for swimming, water sports, activities or just relaxing.   Along the Malecon, or beachfront promenade, you will find a variety of restaurants, hotels, bars and other attractions.  During the summer season there is even a giant sandcastle.  If you “tip” the sculptor $1, he will take your photo.  However, to really enjoy all that Salinas has to offer, you need to get to know it like a local.

Salinas at a Glance

There are two seasons in Ecuador.  Summer runs from December to April and winter from May to November.  The summer in Salinas is usually sunny, with occasional showers.  Daytime temperatures reach the low to mid 80s and nighttime temperatures run in the low 70s.  The winter tends to be overcast to partially sunny, but not rainy.  The winter is actually the drier time of the year and temperatures run about 10 degrees cooler than during the summer.   Because Salinas is semi-arid, it doesn’t experience sticky, tropical humidity.  This makes a comfortable environment for outdoor activities all year long.

As with most beach towns, the dress code in Salinas is casual.  It is perfectly fine to go from beach to restaurant.  Along with your swimsuit, pack plenty of shorts and short sleeved shirts, plus pants and long sleeves if you are visiting in the winter months.   Have a sweater handy, as some days are cooler than others.

Where to Eat

The Salinas area is a prime spot to enjoy fresh fish and seafood, as well as other Ecuadorian specialties.

A great spot to sample those specialties is Delícias de Ecuador, located near the entrance to the Costa de Oro neighborhood on the main road that runs from Salinas to La Libertad.

Prices here are very reasonable.  The daily lunch special or “Almuerzo” includes a soup, entrée and beverage, usually priced at $2.50.

Don’t ask for changes or substitutions on the lunch special; it comes the way it is.  Other options include Seco de Pollo, which is chicken stewed in a tomato-based sauce, and Menestra, lentils or beans served with your choice of grilled chicken, beef or fish.

If a relaxing lunch at the beach, complete with a hammock for a post-meal siesta is your style, drive about 30 minutes north of Salinas to San Pablo.  In this fishing village you will find cabana style restaurants right on the sand, specializing in fresh fish and seafood.

Las Manabas restaurant is one of the best.  If you can’t decide what to order from the extensive menu, try the Chupe de Pescado (fish stew) or Corvina (a mild tasting sea bass), cooked to order.  Most meals run between $3 and $5.

Ecuadorians typically eat a big meal at lunch and a light dinner.

Roca Parilla is the spot to enjoy an Ecuadorian style dinner.  Located a block off the Malecon, it opens at about 6 p.m.  Place your order at the counter, then take your receipt to the grill.  Specialties, which are typically priced from 50 cents to $1 each, include:

Chuzos -shrimp, chicken, beef or sausage grilled on a skewer
Torta de Papa – potato pancake filled with cheese
Torta de Choclo – corn pancake (this one is usually a favorite!)
Muchín – a yucca croquet filled with cheese

No trip to Salinas is complete without a visit to the Cevicherías, casual outdoor eating areas a few blocks off the Malecon that specialize in ceviche.  Shrimp ceviche in a tangy salsa is a good choice.  Shellfish and fish ceviche are also available.  Be aware that the shellfish or fish will not be cooked in the traditional manner.  The citrus juice in the salsa is said to “cook” the fish.  If you have concerns about eating uncooked fish, go with the shrimp version, which is cooked.

Things to See

If you want to browse for souvenirs, visit Mercado de Artesanias, an outdoor flea market in the Chipipe area of Salinas, where you can buy a variety of Ecuadorian handicrafts.

To get a glimpse of days gone by, visit the Museo de Sumpa.  This small, but well thought out museum features exhibits of artifacts from the early residents of the Santa Elena peninsula, including the Las Vegas culture.  It also features a Las Vegas burial site of the “lovers of Sumpa,” mummified remains of two people that appear to have died in an embrace.  You can also tour a cane dwelling typical of those built by the early settlers.

Enjoy a relaxing evening drive a few miles across the Santa Elena peninsula to the Punta Carnero beach, where you can see some of the most beautiful sunsets in Ecuador.  On your way back to Salinas, pass by the Malecon of La Libertad and stop for an evening stroll.

Whether dining, sunsets or beach activities are your idea of a fun time, you will find it in Salinas.

Gerardo & Amy Pinoargote spend their time between their home in Florida and Salinas and together with relatives are building and managing Spondylus II, a small beachfront development in the Costa de Oro area of Salinas, about 2 miles from the Malecon.

This is an area they like due to its privacy, great beach for walking, sunbathing and water sports. Yet it is just a short ride to dining and shopping in the central area.

Spondylus II  is a family business consisting of three towers. Tower A1 is sold out, except for a ground floor ocean front 1000 square foot unit. Several one and two bedroom suites are still available in tower A2, priced from $49,500 to $50,500.

Larger 1300 square foot units are also still available, priced under $110,000. Tower B has just been release for sale and features larger units (1400 – 1500 square feet), in the $120,000 – $135,000 price range.

Spondylus II offers the following amenities… beachfront pool & social area, a workout center, 24 hour security and the Pacific Ocean as a front yard.  All units feature granite kitchen counter tops, tile floors, tile baths, inset ceiling
light fixtures and wooden kitchen cabinets.

To Copyright or Not to Copyright that is the Question

Ok so you’re new to the Internet and you have just written your first e-book and you are wondering what happens if someone takes my work and sells it as there own?  Do I have any recourse?  Should I copyright my e-book and what about my web site?  All of these are good questions and are cause for some interesting discussions on the internet.

Here are the facts:

“All of your content AUTOMATICALLY has a copyright, whether you register it or not… or whether you indicate the copyright or not. However, it’s always better to indicate and date your copyright ownership at the bottom of every page. You are protected online by the Digital Millennium Copyright Act.  That said laws are always vague and to take someone to court and actually win is a tough road to maneuver.”

Everything from April 1, 1989 is copyrighted by the owner or author whether is has a notice or not.

“Considering the vastness of the internet, the possibilities can seem overwhelming the best advice is to take steps to protect yourself the best you can, take action if you find someone has violated your copyright and let go and get on with your business.

1) Copyright every page on your site by adding the following to the bottom…

Copyright © 2009 Your Name. All Rights Reserved.

2) Burn your Web Site to a CD every 3 months and date it. Leave it in your safety deposit box, with a notary or attorney as of that date.”

3) Copyright your e-book upon completion and Copyright your web site every 6-12 months. It’s cheap and not difficult to do. It’s easy and cheap, http://www.copyright.gov.

The first one is an absolute must. The second two are not “must do’s” according to the Digital Millennium Copyright Act. But they set you up much more strongly, if you ever need to go to court. Imagine producing material that has been copyrighted in court, straight from a rip-off site? Wow!

But remember, you likely won’t use this in court — but it makes you bullet-proof with Search Engines. THAT is what is important, if you ever need “swift justice.”  If someone is duplicating your web site or e-book a simple straight forward email to the search engines (Google, Yahoo and MSN) and they will shut the offending site down!

Once you have taken all the steps necessary to protect yourself forget about it!  That’s right because it does not deserve all your time and energy.  You do the best you can, put safeguards in place; occasionally check around to see if you have been copied (http://www.copyscape.com) and if all is well then ALL IS WELL!  You have a better chance of being struck by lightening!  Stay focused on what counts, your success!

This is why the core Pi model portfolio (that forms the bulk of my own equity portfolio) consists of 19 shares and this position has not changed in over two years.  During these two years we have been steadily accumulating the same 19 shares and have not traded once.

The portfolio has done well in 2017, up 22.6%, better than the DJI Index.

However one or even two year’s performance is not enough data to create a safe strategy.

The good value portfolio above is based entirely on good value financial information and mathematically based safety programs developed around models that date back 91 and 24 years.

The Pifolio is a theoretical portfolio of MSCI Country Benchmark Index ETFs that cover all the good value markets developed combining my 50 years of investing experience with study of the mathematical market value analysis of Keppler Asset Management and the mathematical trend analysis of Tradestops.com.

In my opinion, Keppler is one of the best market statisticians in the world.  Numerous very large fund managers, such as State Street Global Advisers, use his analysis to manage over $2.5 billion of funds.

The Pifolio analysis begins with Keppler who continually researches international major stock markets and compares their value based on current book to price, cash flow to price, earnings to price, average dividend yield, return on equity and cash flow return.  He compares each major stock market’s history.

Michael is a brilliant mathematician.  We have tracked his analysis for over 20 years.   He continually researches international major stock markets and compares their value based on current book to price, cash flow to price, earnings to price, average dividend yield, return on equity and cash flow return.  He compares each stock market’s history.  From this, he develops his Good Value Stock Market Strategy and rates each market as a Buy, Neutral or Sell market.  His analysis is rational, mathematical and does not cause worry about short term ups and downs.  Keppler’s strategy is to diversify into an equally weighted portfolio of the MSCI Indices of each BUY market.

This is an easy, simple and effective approach to zeroing in on value because little time, management and guesswork is required.  You are investing in a diversified portfolio of good value indices.

A BUY rating for an index does NOT imply that any stock in that country is an attractive investment, so you do not have to spend hours of research aimed at picking specific shares.  It is not appropriate or enough to instruct a stockbroker to simply select stocks in the BUY rated countries.  Investing in the index is like investing in all the shares in the index.  You save time because all you have to do is invest in the ETF to gain the profit potential of the entire market.

To achieve this goal of diversification the Pifolio consists of Country Index ETFs.

Country Index ETFs are similar to an index mutual fund but are shares normally traded on a major stock exchange that tracks an index of shares in a specific country.  ETFs do not try to beat the index they represent.  The management is passive and tries to emulate the performance of the index.

A country ETF provides diversification into a basket of equities in the country covered.  The expense ratios for most ETFs are lower than those of the average mutual fund as well so such ETFs provide diversification and cost efficiency.

Here is the Pifolio I personally use.

70% is diversified into Keppler’s good value (BUY rated) developed markets: Australia, Austria, France, Germany, Hong Kong, Italy, Japan, Norway, Singapore and the United Kingdom.

30% of the Pifolio is invested in Keppler’s good value (BUY rated) emerging markets: Brazil, Chile, China, Colombia, the Czech Republic, South Korea, Malaysia and Taiwan.

The Pifolio consists of iShares ETFs that invested in each of the MSCI indicies of the good value BUY markets.

For example, the iShares MSCI Australia (symbol EWA) is a Country Index ETF that tracks the investment results the Morgan Stanley Capital Index MSCI Australia Index which is composed mainly of large cap and small cap stocks traded primarily on the Australian Stock Exchange mainly of companies in consumer staples, financials and materials. This ETF is non-diversified outside of Australia.

iShares is owned by Black Rock, Inc. the world’s largest asset manager with over $4 trillion in assets under management.

Pi uses math to reveal the best value markets then protects its positions using more math created by Richard Smith founder and CEO of Tradestops.com to track each share’s trend.

We use Smith’s  algorithms that calculate momentum of the good value markets.

The Stock State Indicators at Tradestops.com act as a full life-cycle measure that indicates the health of each stock. They are designed to tell you at a glance exactly where any stock stands relative to Dr. Smith’s proprietary algorithms.

Kepppler’s analysis shows the value of markets.  The SSI signal indicates the current trend of each stock (performing well, or in a period of correction, or stopped out).

The SSI tells you one of five things:

Akey component of the Stock State Indicator (SSI) system is momentum based on the latest 521 days of trading.  A stock changes from red to green in the SSI system only after it has already gone up a healthy amount and has started a solid uptrend.

How SSI Alerts Are Triggered

If the position has already moved more than its Volatility Quotient below a recent high, the SSI Stop Loss will trigger.  This is an indicator that the position has corrected more than what is normal for this stock.  It means to take caution.

Below is an example of how SSIs work.  This example shows the Developed Market Pifolio that we track at Tradestops.com.

At the time this example was copied, all the ETFs in the Developed Market Pifolio (above) currently had a green SSI.

We do not know when the US market will fall.  We only do know that it will.  We also do not know if, when the US market corrects, global markets will follow or rise instead.

The fact that the Pifilios are invested in good value markets reduces long term risk.

Additional protection is added by using trailing stops based on the 521 day momentum of each stock in the Pifolio.

Take for example the graph below from our Tradestops account that shows the iShares MSCI United Kingdom ETF.  This ETF had a green SSI and a Volatility Index (VQ) of 13.26%.  This means the share can move 13.26% before there is a trend shift.

Pi purchased the share at$31.26 and in this example the share was $34.43 and rising.  Tradestop’s algorithms suggested that if the price drops to $31.69 its momentum would have stopped and it would have shifted into trading sideways.   The stop loss price is currently $29.86.  If EWU continues to rise, both the yellow warning and the stop loss price will rise as well.

When the US stock market bull ends, know one knows for sure how long or how severe the correction will be.

When the bear arrives, what will happen to global and especially good value markets?

No  one knows the answer to this question.

Correction creates an economic downturn and again to war.

We’ll look at some important information about Ecuador wills and Ecuador’s legal system in a moment.

I mentioned our foundation here  because it helps us gained fulfillment in our business, plus creates tax and asset protection benefits plus is part of our estate planning to make sure that the people of Ecuador are helped even after we pass.

Making sure that your assets held abroad are protected and properly conveyed in your estate requires extra planning.

Yet many Ecuador Living subscribers have been buying real estate or are moving to Ecuador without giving thought to the added complexity in their estate plans and other legal requirements.

I strongly suggest that you review you entire estate with both a local and Ecuadorian attorney. Here are some excerpts from an Ecuador Living report on why.

The Western world operates on two systems of law, the civil law of ancient Rome, and the common law of England.  These two systems have a lot in common, yet in many important areas they differ.

These differences can create legal conflicts in contracts, wills, trusts, parental rights and even residency.

The passing of wealth to heirs for example is one area that differs.

Few people coming from North America (which operates under a British common Law system), understand that US, Canadian or Ecuador wills do not work in Ecuador if challenged.

Many legal systems have evolved from The Roman civil code.  The Napoleonic Code is the French version, established under Napoléon I in 1804.  The Napoleonic code was not the first legal code to be established in a European country with a civil legal system though. The Codex Maximilianeus bavaricus civilis was reated in Bavaria arund 1756).  The Allgemeines Landrecht formed in Prussia, around 1794.  The West Galician Code,  began in part of Austria around 1797.

Many of the civil codes in Latin America are based on an original work derived from the French code and Castillan law.  Chile was the first to accept this type of legal system in 1855.  Ecuador followed in 1858.  El Salvador,  Venezuela,  Nicaragua, Honduras, Colombia and Panama are other countries with a legal system based on this foundation.

In this Ecuador legal system, the will is called the testament and allows the testor to direct the disposal, in whole or in part, of their property, upon death.   The testor retains the right to revoke the provisions in the testament anytime during his or her life.

However there is a difference in common and civil law as to what is a person’s property is.   In most civil codes, the wife automatically owns half of all property unless otherwise  stipulated in a formal way. The children own the other half.  Period. A will cannot supersede this fact.

If a person’s will leaves all of his or her property to his or her spouse, the will works fine UNLESS the children contest the will. If they do the testament will not be valid.

This can create complications in simple circumstances.  If the circumstances become complicated… for example children from two or more marriages… then problems could mount.  There is even a concern in my mind that a surviving spouse could lose investor residency status if the inheritance falls below required minimums.    A spouse could lose residency and a house!

In a common law country a person can write a will on a scrap of paper, throw it in a drawer (not advised) and that may be enough.  Though it also might not.  In a civil code jurisdiction such a will definitely will not work!

So if you create a will in Ecuador and then write another later… be sure to make the change official. Otherwise the new will may not work.

In a common law legal system wills do not have to be recorded and often the act of writing a new will allows the new document to supersede the old.

Ecuador’s Act reforming the Civil Code, of August 17, 1989 updated a number of areas relating to  covers relationships between a children and their parents, marriage, divorce, the status of wives, marital property and marital agreements.

Having an attorney to help you with estate planning in every country where you hold property makes sense…  especially if  two of the countries have different legal systems.

The US attorney we use is our friend (and trustee of LOTS) Joe Cox.

Joe’s firms specializes in cross border tax and estate planning, asset protection and real estate.

He provides an incredible system called The Strategic Snapshot which is an easy to use, color coded visualization of a person’s structures, corporate entities, estate plan and assets. We use the snap shot and have found it incredibly useful in seeing how everything from a legal point of view should fit.

Conversion to Manager-Managed LLC Format

Many individuals concerned with asset protection have formed a Limited Liability Company (“LLC”) in an effort to protect their assets. In fact, most people do not know that Florida was the second state in the United States to draft LLC legislation (dating back to 1982). Most LLCs we see in our daily practice have been formed as member-managed LLCs, that is, when the members (i.e., owners) of the LLC control and manage the LLC as well. However, due to recent changes in the law regarding LLCs, we are now recommending that any Member-Managed LLC be converted into a Manager-Managed LLC format.

The intent of this recommendation is to increase the creditor protection of the LLC should the Member be involved in a lawsuit.

For example; under a Member-Managed LLC, if a creditor of the Member is able to obtain the LLC membership units (by court order, for example), the creditor could obtain management rights and make decisions for the LLC. At least one recent court ruling (from Colorado) makes this result a possibility. However, under a Manager-Managed LLC format, the Manager retains control of the management of the assets held by the LLC even if someone else “controlled” the LLC membership units.

In a Manager-Managed LLC, an elected Manager (pursuant to the Operating Agreement) manages the LLC. Note, that an existing member can act as the initial Manager of the LLC, and an independent Manager can be elected at a later time, if desired. Under a Manager-Managed LLC format, if a member was successfully sued, and the creditor obtained the member’s LLC membership units, the Manager could withhold distributions from all Members and the creditor would receive nothing. This result could deter a potential creditor from filing an unjustified or otherwise frivolous claim.

We live in a complicated world often made more frustrating by the legal system.  Legal systems are problematic enough when one lives and resides in one country.   Difficulties can compound when living and or holding assets in two countries or more… especially if both legal systems…common and civil become involved.  So get an attorney and get advice so you, your spouse and your heirs never find your results uncivil.

You may still incur tax liability in your country of residence or citizenship. For example if you are a US citizen you may have US capital gains or Alternative Minimum Tax liability.

This is why it is of utmost importance that you consult a tax attorney on such matters.

“Gary, I continue to be bothered by an unjust lawsuit that is actually  extortion.  The legal fees are crazy. Such is the legal system now that even when you are totally innocent, you lose even if you win.”

When you invest and do business globally, assets held correctly abroad are safer from seizure via civil action.

However, we have also continually warned of the great risk of doing global investing and business  without good legal advice. Monday’s message looked at the importance of making sure that you use overseas banks in the correct way.

An excerpt from a recent article in the Financial Times entitled “Swiss agree to relax bank secrecy rules” points out the importance of this advice.

The article says:

BERNE, March 13 – Switzerland agreed on Friday to relax its strict bank secrecy rules and co-operate more on tax evasion in a last-ditch attempt to fend off a global crackdown on tax havens that is rattling the offshore banking industry.

In a landmark statement, the Swiss government said it would embrace standards for tax cooperation and exchange of information set by the Organisation for Economic Cooperation and Development, meaning more information on suspected tax evaders will be shared with other countries.

”Banking secrecy does not protect tax crimes. International cooperation on taxes has become more important given the globalisation of financial markets and in particular against the background of the financial crisis,” Swiss president and finance minister Hans-Rudolf Merz told a news conference.

A decision on Thursday by tiny offshore rivals Liechtenstein and Andorra to adopt more tax co-operation has put even more pressure on Berne.

It comes on the heels of moves by other centres, including Singapore, Hong Kong, Jersey and the Isle of Man, to open up.”

An article in the New York Times outlines the focus importance that taxing authorities have placed on tax havens.  The article was about how US President Barrack Obama acted as a mediator during a recent tense meeting between The French President Sarkozy and Chinese President Hu who were arguing about tax havens during the Group of 20 meetings.

The article said:

“Mr. Sarkozy wanted the big communiqué produced by the Group of 20 to endorse naming and shaming global tax havens, maybe even including Hong Kong and Macao, which are under China’s sovereignty. Unsurprisingly, Mr. Hu was having none of it. He appeared angry that Mr. Sarkozy was effectively accusing China of lax regulation, and that the French leader was asking China to endorse sanctions issued by the Organization for Economic Cooperation and Development, a club of wealthy nations that Beijing has yet to join.

According to accounts provided by White House officials and corroborated by European and other officials also in the room, Mr. Obama escorted both men, one at a time, to a corner of the room, to judge the dispute. How about replacing the word “recognize,” Mr. Obama suggested, with the word “note?”

The result: “The era of banking secrecy is over,” the final communiqué said. “We note that the O.E.C.D. has today published a list of countries assessed by the Global Forum against the international standard for exchange of tax information.” Hong Kong and Macao did not appear on the list.

In other words, be global by all means… but make sure you have a local attorney who helps you do everything legally and correct.

Back to the fixer uppers.

If a person spends time in Ecuador  and stays alert, they’ll see many incredible fixer upper bargains.

Just over a year ago, Merri and I bought the four story office building shown above.   We began cleaning it up an converting two floors into condos.

I could sell these for double what I paid… and still have the two downstairs floors… though they are not for sale.

Construction costs are low. Local craftsmen are handy.  They’ll do things you ask.  So we can afford to use great tiles in the kitchen but keep costs down.

Where we had huge walls we said…”How about windows with a view?”.   The builder  figured out what height was needed to see Mt. Cotacachi and simply knocked the window openings in the walls. Then he built hardwood window surrounds that frame this view.

Fixing up has property provided Merri and me with sopme nice extra profit… that is totally tax free in Ecuador. Though our last Ecuador fixer upper profits did create some US tax liability.

Ecuador Comparisons & Weather-Weathering Weather


We are on the road making Ecuador comparisons, weathering the weather and wishing for Ecuador weather.

In other words Merri and I have extended our Florida meanderings so we do not arrive back at our North Carolina farm in a snow storm.

We have been looking at Ecuador income potential and so let’s view this hotel for sale on Ecuador’s beach.

Ecuador weather looked pretty grey on the day I took these shots… but we never have to worry about snow!

Readers  often write asking about the weather in the Andes. If you look up Quito weather for example it says “Rain” almost every day.  This is a puzzle as it is not true. We have been traveling though Florida getting a feel… wondering what has led us here.  Innocently wandering around… looking… checking…. waiting.

Of course the weather is great… though a bit sticky at times…. plus too dry right now. This is Florida’s third worst drought in history.

We can’t help but make comparisons with Ecuador.

Three things I noticed in the last two nights spent at Holiday Inns were:

First, when hotels here quote room rates…. they do not let you know of the tax.

In Ecuador we always provide this warning so guests know what the entire cost will be.

Secondly, hotels do not seem to have noticed the economic downturn.   Prices seem pretty high $119 for a Holiday Inn express and $129 for a Holiday Inn… plus the unmentioned taxes… for the typical box.This is double what our hotel costs at $59 (plus 22% tax).

Third, comes the free breakfast… overcooked buffets… terrible bakery pastries and everything served on foam plates and cups… with plastic knives and forks… without much (or really any service)… including the “wonderful” Smuckers jam.

I think of our hotel’s great cooked when you arrive, full breakfast… juice….fresh fruit made into an art form… hand made butter and hand made marmalade… plus choice of eggs in numerous ways… bacon or ham.  Though I have to be honest, I do not like the bread our hotel serves… next thing on my list to fix.

This is not a complaint… just a comparison.  Remember we are looking to buy in Florida because we also love it here.

Merri and  are having a great time. We are enjoying Florida’s warmth… seeing a lot of territory… ranging from Naples to Lakeland… Winter Haven… up to Clermont…. Mt Dora…  Tavares… Leesburg… Deland…  St Augustine… Palakta… Zeypher Hills plus some really out of the way (our favorite) places like Ridge Manor…  Crows Bluff…  Lady Lake… Fruitland Park.

This note is written from outside of Gainesville and today we inspect the Suwanee River.

The best place we have seen so far was remote… on the Withlacoochee River. We would have purchased this on the spot… except… it should be renamed…  Withlacoochee  Puddle!   We were very sad to see numerous lakes and rivers that are pretty much gone… during the terrible drought we are seeing here.

Multi Currency Thought

This reminds me of an important multi currency fact. The global economic downturn has driven the price of many shares down.. but has not stopped basic essential needs… like our need for water.

Shares of companies denominated in strong currencies that provide excellent needs can offer special value.

Take the water share we have followed for years… Hyflux.

Hyflux Ltd is company listed on the Singapore Stock Exchange that has a proprietary water filtering system that does business  in China, India, the Middle East and North Africa (MENA) region as well as Singapore and Southeast Asia.

These shares have fallen from a high of $4.88 to $1.72 as you can see in the chart below from uk.finance.yahoo.com

The Ali Shungu hotel has been for sale for some time… but we felt the price was  too high…  even though this is an excellent facility with wonderful grounds.

There is great profit potential with overseas businesses plus there is also enormous tax benefits with an Ecuador or overseas business.

Ali Shungu’s owners wanted a million dollars. “too much”, we thought, “even though it has this full restaurant”.

There are also enormous legal, asset protection and tax benefits that an overseas business can bring. The most effective structure from a tax deferral point of view is a non U.S. structure (corporation, LLC, limited partnership or trust) that operates entirely outside the U.S. and that is owned 50% or more by a non U.S. person.

Then the owners dropped their asking price to $750,000.  “Getting closer”, was out thinking… but not quite low enough despite this wonderful patio.

Using an overseas structure, a corporation owned at least half by non U.S. citizens or residents, has helped me expand our hotel business.

Some business owners do not want to have someone else own half their business. If this is the case, I recommend that you donate half the business to some U.S. charities. Pay them some dividends as your profit and treat them well. This can help your business be more fulfilling as well as profitable.

Then recently the owners offered us a $150,000 commission to sell the hotel. We are not brokers and do not take commission so our reply was “cut the price for our readers”!  This would place the price at $600,000… an interesting value.

The message from our reader below shows that some of you still do not believe me so I have to repeat again that bank privacy has slowly been eroded over the past thirty years and I cannot see why the trend will not continue.

Gary: I read your article on loss of bank privacy, t’is true. Where internationally could one put US mutual funds? Is there any safe haven with bank privacy in the world anywhere now that you could recommend?

One should not hide money abroad and rely on bank privacy to protect them. Forget about government attacks. These are bad enough but I cannot begin to tell you the horror stories I have crossed in the past three decades in which bank privacy was blown by bank errors. For example a London bank mistakenly mailed me the secret bank account of an Iranian diplomat who was hiding money in London. A Viennese banker inadvertently faxed me four pages of private information that could have put several people in serious trouble. A Swiss banker once left his client list with names, addressees and account numbers laying on a table at a seminar were I was speaking with him.

There are too many ways to get caught in addition to the onslaught of governments to reduce privacy. Look for legal ways to keep your financial affairs private instead. One such way is through the use of overseas insurance policies.
